US Student Visa Rules Tightened Under Trump Administration

Obtaining an education in a different country has always involved careful planning, but new immigration changes are now likely to add to the difficulty faced by international students, visitors and foreign journalists.

While some government officials said that the changes would better regulate immigration process, many critics insist that these changes will result in more complex situations for legal immigrants coming to the country.

The Change in Validity of Student Visas

For many years, international students have been coming to the USA based on a system that allowed for their continuous stay in the country as long as they are studying in their program.

But now this system is going to change.

According to the latest announcement by the Department of Homeland Security, a variety of different types of visas will be subject to a definite period of validity instead of being valid throughout a student’s studies.

The introduced rules are going to come into force two months after the publication in the Federal Register.

All Visa Types Have Different Time Constraints

Holders of I visas for foreign journalists have a muss shorter duration. Their visas will be valid for no more than 240 days, whereas citizens of China can get their visas for just 90 days.

New Restrictions on Graduate Students

Graduate students cannot change their educational plans or change institutions without receiving the corresponding approval.

Another major change is about the fact that previously many international students had 60 days to stay in the country after graduation while being involved in planning their future. The new process gives them just 30 days.

Not everybody is pleased with the new policies in place.

Doug Rand, who used to work for the Department of Homeland Security, argues that these changes do more harm than good.

His opinion is that the USA would benefit from making it easier to welcome international students rather than adding even more obligations.

Even immigration analysts have doubts about whether the regulations will discourage talented students willing to come and study in America.

Too Short Time to Get Employed After Graduation

Immigration experts are worried about the decision to shorten the time after graduation.

David Bier, an analyst from the Cato Institute, believes that graduates will not have enough time to find employers who will agree to sponsor their visas for employment purposes.

The critics of this decision assume that students will not be able to secure the sponsorship and thus fall out of legal status despite all of their efforts to study in America.

International students already experience difficulties in finding a job without additional time pressure.

DHS Representatives Say the Policy is Necessary Due to Increasing Numbers of Issued Visas.

According to those in the know, tracking such huge numbers of temporary visa holders has become a hassle making the new rules necessary.

If one wants to stay back, one would need to obtain additional approval.

This new regulation means visa holders cannot remain in the US once their stay has run out.

If one would like to continue with their studies or work under the same or any other eligible visa, they must submit an application for an extension with the DHS before their authorized stay ends.

In case of non-approval, they will have to exit USA and seek authorization to enter again.

According to the DHS, the goal is to keep a check on every temporary visitor in terms of their immigration status.

The information for students planning on attending an educational institution in the U.S. is even more critical with these changes.

Future applicants may want to consider longer timelines when it comes to choosing a course program, performing certain internships, planning for graduate studies, and looking for jobs after graduation.

Along with applicants, educational institutions, immigration consultants, and various employers may also need to adapt and change the methods of support for international students with the adoption of new regulations.

Important Change in U.S. Immigration Policy

The new rules concerning visas are just another significant development in the U.S. immigration system when it comes to the arrival of various individuals for the purposes of education, cultural exchange, and journalism.

According to the supporters of the idea, a stricter deadline means better immigration processes and more effective regulation.

On the contrary, opponents of the idea state that the new regulations will create unnecessary hurdles for people that already follow the legal immigration track.

As the changes are about to come into realization, various groups of people will be watching closely to see the impact of the new regulations on their education, work, and reporting in the U.S.
